ORDER

The petitioner, who was arrested and remanded to judicial custody on 14.02.2026 for the alleged offences under Sections 126(2), 296(b), 309(4), 311, and 351(3) of B.N.S. in Cr. No.139 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused demanded money from the defacto complainant, who is running an old paper shop and when the defacto complainant refused for the same, the accused robbed a sum of Rs.1,970/- at knife point. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He would further submit that the petitioner is under incarceration since 14.02.2026 and the petitioner is ready and willing to abide by any condition that may be imposed by this Court and hence prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and opposed to enlarge the petitioner on bail by stating that the petitioner has also involved in two other previous cases and investigation is at preliminary stage.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. From the submissions made by the learned Government Advocate, it is clear that the petitioner has 2 previous cases in his credit and in this case,

investigation is at preliminary stage, as the petitioner has been under incarceration only since 14.02.2026. In such view of the position, this Court is of view that it is not an appropriate time to enlarge the petitioner on bail.

7. Accordingly, this Criminal Original Petition is dismissed. 13-03-2026 MJS Note:
