ORDER

The petitioner, who was arrested and remanded to judicial custody on 29.01.2026 for the alleged offence under Section 126 (2), 296 (b), 309 (4), 311, 351 (3) of BNS, in Crime No.97 of 2026 on the file of the respondent Police, seeks bail.

2. The case of the prosecution is that the petitioner waylaid the defactocomplainant and robbed a sum of Rs.1450/- at knife point.

3. The learned counsel for the petitioner would vehemently submits that though the petitioner was charged for the offence of robbery, he is innocent and he has been forced to be in incarceration since 29.01.2026. However, to dislodge the submissions of the learned counsel for the petitioner, the learned Government Advocate (Criminal side) would bring to the knowledge of this Court that there are eleven pending cases against this petitioner and out of which two murder cases and two NDPS cases and other similar nature of offences and he has also brought to the knowledge of this Court that the petitioner has also committed offence even within the prison. 4.In view of such history of the petitioner, this Court is of the view that if the petitioner is enlarged on bail, he would become threat to the peaceful existence of the society. Therefore, this Court is not inclined to enlarge the petitioner on bail at this juncture.

5.Accordingly, this Criminal Original petition is dismissed. 05-03-2026 ep
