A.No.2846 of 2022 in O.P.DR.No.28793 of 2021 A.No.2846 of 2022 in O.P.DR.No.28793 of 2021 KRISHNAN RAMASAMY.J., This application has been filed seeking to refund the stamp duty inadvertently paid vide e-court fee receipt No.TNCT084212105W334 for an amount of Rs.1,98,650/- in O.P.Diary No.28793 of 2021.

2. It is stated by the applicant/petitioner that she filed an original petition seeking to issue succession certificate vide O.P.Diary No.28793 of 2021. She further stated that after a formal return, the above said O.P. was cleared by the examiner and Reserve Bank Challan was issued to pay 3% succession duty for succession certificate. Thereafter, she paid 3% succession duty through stock holding vide e-court fee receipt No.TNCT084212105W334 for Rs.1,98,650/- on 08.09.2021 inadvertently instead of depositing with Reserve Bank of India. Therefore, she filed an application in A.No.677 of 2022 in O.P.Diary No.28793 of 2021, to consider the payment done through stock holding and since this Court was not inclined to entertain the same, the applicant/petitioner withdrew the said application. Hence, the applicant/petitioner filed the present application.

3. This Court is satisfied with the reasons stated in the affidavit filed in support of this Application. Accordingly, this Application stands allowed as prayed for.
