Writ Petition filed under Article 226 of the Constitution praying to issue a Writ of Mandamus, directing the first respondent to pass suitable order for change of investigation of the petitioner's complaint dated 24.05.2024 from the file of the third respondent to some other agency. O R D E R

This Writ Petition has been filed for change of investigation in the complaint lodged by the petitioner from the file of the third respondent to any other investigating agency.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the first to third respondents and perused the materials available on record.

3. Admittedly, on the complaint lodged by the petitioner, no FIR has been registered so far. Before registration of the First Information Report, investigation does not arise. Therefore, there is no question of 2/5

transfer of investigation from the file of the third respondent to any other investigating agency. Hence, this Writ Petition is devoid of merits, and it is liable to be dismissed.

4. Accordingly, this Writ Petition is dismissed. However, the third respondent is directed to conduct an enquiry on the complaint lodged by the petitioner and complete the same within a period of two weeks from the date of receipt of a copy of this order.
