Respondent/Complainant in both Crl.O.Ps COMMON PRAYER: Criminal Original petitions have been filed under Sections 439 (1) (b) of the Code of Criminal Procedure, to relax the bail condition order passed in Crl.M.P.No.3122 and 3123 of 2018 dated 11.01.2019 in R.R.No.38 of 2018, on the file of the learned Addl. Chief Metropolitan Magistrate, (E.O.II), Egmore, Chennai, in so far as it concerns the appearance of the petitioners/A1 and A2 before the respondent.
For Petitioners : M/s.S.Baskaran in both Crl OPs For Respondent : Mr.N.P.Kumar in both Crl OPs Special Public Prosecutor for Customs C O M M O N O R D E R These two Criminal Original petitions have been filed seeking for relaxation of the bail condition imposed by the Court below.
2. The Court below, while granting bail to the petitioners have imposed conditions to the effect that the petitioners should appear before the respondent daily at 10.30 a.m and sign https://hcservices.ecourts.gov.in/hcservices/
until further orders and shall appear before the Court below on 25.01.2019 and on subsequent hearing dates.
3. The learned counsel for the petitioners submitted that the petitioners have been regularly complying with the conditions imposed by the Court below and hence, he prays for relaxation of the above condition.
4.The learned Special Public Prosecutor would submit that the petitioners are complying with the conditions regularly.
5. Taking into consideration, the facts and circumstances of the case, the condition imposed by the Court below is modified to the effect that the petitioners shall appear before the respondent twice in a month i.e., 1st and 15th of every month at 10.30 a.m., until further orders.
6.These Criminal Original Petitions are disposed of, with the above modification.
