This Criminal Original Petition is filed to quash the FIR in Crime No.849 of 2023 dated 29.12.2023 by the Peelamedu Police Station for offence under Section 420 IPC.

The learned counsel appearing for the petitioner submits that an identical complaint was given to Sulthanpet police station and the same was closed. While so, without jurisdiction Peelamedu police has entertained the complaint.

The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the complainant's residence is within the territorial jurisdiction of Peelamedu and the earlier complaint given to Sulthanpet police registered as C.S.R., never been investigated and therefore, the respondent police is bound to investigate the complaint. If any commission of cognizable offence is made out final report will be filed.

This Court on perusing the records finds that there is no illegality in entertaining the complaint. Hence, this Criminal Original Petition stands dismissed. It is for the petitioner to cooperate with the investigation and the respondent police shall consider the material gathered during the investigation and proceed in accordance with law. Consequently, the connected Criminal Miscellaneous Petition is 2/4

closed.
