..Respondent(s) Writ petition is filed under Article 226 of the Constitution of India seeking for issuance of a writ of mandamus to direct the respondents to survey, measure and fix the boundaries of the land situates in the survey no.265/ 2I at Karukanahalli Revenue Village, KoneriAgraharam Village Gramanatham, Denakanikottai Taluk, within Royakottai sub- Registration District, Krishnagiri Registration District measuring an extent of 378 square metres, by considering the application dated 20.12.2025 in Petition No.2025/ N123/ 31/ 008226 with necessary police protection within a time frame to be fixed by this court. ORDER
This writ petition has been filed seeking for a direction to the respondents 1 and 2 to survey and demarcate the property, which according to the petitioner is owned by him, within a time frame to be fixed by this Court.
2. The petitioner had submitted a representation dated 20.12.2025 seeking for survey and demarcation of the property morefully described in the prayer to this writ petition. Since the said representation has not been considered till date, the petitioner has filed this writ petition.
3. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 and 2.
4. No prejudice will be caused to the respondents 1 and 2, if the aforesaid representation of the petitioner is considered, on merits and in accordance with law, after hearing the objections if any from the neighbouring land owners as well as any other party whom the respondents 1 and 2 deem it fit to enquire. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the land in question, the respondents 1 and 2 are directed to issue notice to the neighbouring land owners, and also to any other party, whom they deem it fit to
enquire.
(b) After receiving objections if any and after considering the same, the respondents 1 and 2 shall conduct survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.
(c) If any need arises, the respondents 1 and 2 are permitted to submit a petition for police assistance, and upon receipt of such request, the third respondent police shall render necessary police assistance for conducting survey and demarcation of the subject property.
