Petition under Article 226 of the Constitution of India praying for issue of a Writ of Mandamus forbearing the respondents and their subordinates or any other officials tracing power through them from in any manner interfering or disturbing or dispossessing the petitioner without following due process of law in respect of petitioner's property comprised in Survey No. 561/9, 10, 11 at Chinnasalem (South), Chinnasalem Village, Chinnasalem Taluk and Kallakurichi District based on the petitioner's representation dated 01.03.2021. O R D E R
(Order of the Court was made by N. KIRUBAKARAN,J.) The matter was heard through videoconferencing. The petitioner submits that he has got agricultural lands in Survey Nos. 560, 561, 562, 654 and 652 at Chinnasalem (South), Chinnasalem Village, Chinnasalem Taluk, Kallakurichi District. The petitioner has been doing cultivation in those lands and he has also constructed poultry sheds in Survey Nos. 561/9, 10,11 at Chinnasalem (South), Chinnasalem Village, Chinnasalem Taluk, Kallakurichi District. According to the petitioner, some persons, who have got animosity with the petitioner, have given a complaint and the petitioner's apprehension is that some action would be taken against him, as some revenue officials, had visited the petitioner's land and given one month's time for removal of all the crops and other articles. Hence, the petitioner gave a representation on 01.03.2021 requesting the respondents to follow due process of law while taking any action against him. Since the said representation has not been disposed of, the petitioner has come before this Court.
Heard Mr. K. Ramesh representating Mr.P. Rajavel, learned counsel for the petitioner and Mr.S. Kamalesh Kannan, learned Government Advocate for the respondents. The petitioner only seeks that due process of law has to be followed before any action is taken against him in resepct of his occupation of the property in S.Nos. 561/9, 10 and 11 at Chinnasalem Village, Chinnasalem Taluk, Kallakurichi Taluk and the representation given by the petitioner also states sp. Hence, there shall be a direction to the respondents to follow due process of law before taking any action against the petitioner. The writ petition is disposed of with the above direction. No costs.
