The petitioner, who apprehends arrest for the alleged offence under Sections 296(b), 118(1), 351(3) of the B.N.S. in Crime No.Not Known of 2026, on the file of the respondent police seeks anticipatory bail. 1/4

The case of the prosecution is that due to previous enmity, there was wordy quarrel arose between the petitioner and the defacto complainant in which, the petitioner along with other accused abused the defacto complainant using filthy language and assaulted him and also threatened him with dire consequences. Hence, the case.

The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the defacto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and, upon instructions, submitted that on account of altercation between the petitioner and the defacto complainant's husband, there was an injury to the defacto complainant's husband due to which, he was admitted into the hospital for 6 days. He would further submit that the injured has been discharged from the hospital on 09.03.2026 and that no previous criminal antecedents have been registered 2/4
against him. Hence, he strongly opposed to grant anticipatory bail to the petitioner.
5. Heard the submissions made by the learned counsel on either side and perused the materials available on record.

Though the injured has been discharged from the hospital, taking into consideration of the gravity of offence and also considering the registration of the First Information Report on 26.02.2026, this Court is of the view that if the petitioner is enlarged on bail, there is every possibility of tampering the witnesses and there will be a commotion in the vicinity. Hence, this Court is not inclined to enlarge him on anticipatory bail.
