2. Taking into consideration the facts and circumstances of the present case and after hearing the learned counsel appearing on either side, this Court is convinced with the reasons assigned in the affidavit filed in support of these applications.

3. Accordingly, both these applications are allowed. It is left open to the first respondent/first defendant to file additional written statement with regard to certain averments that have been made in the reply statement filed by the plaintiff. The additional written statement shall be filed on or before the next date of hearing. The reply statement and the additional documents are not accompanied with statement of truth. When this was pointed out to the learned counsel for the plaintiff, the 1/3

learned counsel sought for some time to file the statement of truth. The statement of truth shall be filed after serving a copy to the learned counsel for the first defendant before the next date of hearing. 22.11.2021 (1/4) mk 2/3
