ORDER

The petitioner apprehends arrest for the alleged offence under Sections 296(b), 115(2), 109 of BNS, equal to 294(b), 323, 307 IPC in Crime No.63 of 2026 on the file of the respondent police seeks anticipatory bail.

The case of the prosecution is that the complainant is doing the business of purchasing silver ornaments in wholesale and supplying the same to nearby jewellery shops in Vaniyambadi for the past four years. On 18.02.2026, the complainant and his friend, along with his car driver Santhosh, went separately to supply silver ornaments to the shop customers. It is alleged that at about 7.00 p.m., the complainant's friend and his driver had parked the vehicle under a tree near Ponniyamman Temple. At that time, unknown persons came there in a four-wheeler, threatened the complainant's friend and the driver with dire consequences by showing a knife and snatched away 15 kgs of silver ornaments. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and that he has not committed any offence as alleged by the prosecution. He further submitted that there is no previous case against the petitioner. Hence, he prayed to grant anticipatory bail to the petitioner.

4. From the submissions made by the learned Government Advocate (Crl. Side) for the respondent police, the prosecution case is that the petitioner and other accused joined together and, at knife point, looted 36.30 kgs of silver ornaments.

5. Considering the gravity of the allegations projected by the learned Government Advocate (Crl. Side) and the serious nature of the offences, and also noting that A1 and A2 have already been arrested, this Court is of the view that if the petitioner is enlarged on anticipatory bail, it may affect the course of the investigation. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.
