C.M.P. No. 23324 of 2023 in W.A. No. SR37482 of 2021 R. MAHADEVAN, J andsss MOHAMMED SHAFFIQ, J This civil miscellaneous petition has been filed by the petitioner seeking to condone the delay of 1532 days in filing the above writ appeal.
2. Heard the learned counsel for the petitioner and perused the affidavit filed in support of this petition, wherein, it has been stated due to the ill health and personal inconvenience of the petitioner, he has not contacted his counsel and later, when he contacted, he came to know that his Writ petition was dismissed and hence, the delay of 1532 days occurred, which is neither wilful nor wanton and therefore, the same may be condoned.
3. Having regard to the reasons stated by the petitioner, which appear to be bona fide, considering the huge delay in filing the above appeal, delay is condoned on condition that the petitioner shall pay a sum of Rs.2,000/- to the credit of Tamil Nadu Mediation and Conciliation Centre, Madras High Court, Chennai, within a period of two weeks from the date of receipt of copy of this order. 4.
Upon production of receipt for payment of costs, this civil miscellaneous petition stands ordered.
