C.M.P.No.6908 of 2023 in C.M.A.SR.No.37887 of 2023 N.MALA,J, This Petition has been filed to condone the delay of 135 days in filing the above Civil Miscellaneous Appeal.
2.Mr.R.Srinivasalu, learned counsel appears for first respondent and Mr.C.Ramesh babu, learned counsel appears for second respondent.
3.The learned counsel for the 1st and 2nd respondent submits that they have no objection to the delay of 135 days being condoned but subject to condition that the petitioner shall forfeits the interest for the delay period of 135 days.
4.In view of the submission made by the learned counsel for the 1st and 2nd respondent, the delay of 135 days is condoned subject to condition that petitioner shall forfeits the interest for the delay period of 135 days.
5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same for admission.
Registry is further directed to print the name of the respondents counsel at the time of admission. Accordingly, this CMP is ordered.
