ORDER

The petitioner, who was arrested and remanded to judicial custody on 22.09.2025 for the alleged offences under Section 303(2) of B.N.S. in Cr. No.493 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the vehicle of the defacto complainant namely Honda Activa 6G Brown colour bearing Registration No.TN43 L 6486, which was parked in front of his house on 19.06.2025, was found missing on 20.06.2025. Hence the case.

The learned counsel for the petitioner would submit that totally 8 cases have been registered against the petitioner on the same day and she would further submit that all the said cases are put up cases and the petitioner is an innocent and he has been incarcerated since 22.09.2025 and the offence charged against the petitioner is under Section 303(2) of B.N.S. and no serious offence and hence prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and strongly opposed to grant bail to the petitioner as he has 35 previous cases registered against this petitioner and some of them have been disposed of and many of the cases are of similar nature. It is the further submission of the learned Government Advocate that if the petitioner is enlarged on bail, he would again commit similar offences.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

From the perusal of list of cases pending against the petitioner, shown by the Government Advocate, it is seen that almost all the cases are of similar nature and therefore it clearly demonstrates that whenever this Court enlarged the petitioner on bail, he had misused the liberty. Therefore, this Court is of the firm view that if the petitioner is released on bail, he would again commit similar nature of offence. In view of such position, it is not desirable to enlarge the petitioner on bail.

7. Accordingly, this Criminal Original Petition is dismissed. 10-03-2026 MJS Note:
