Crl.M.P.No.1858 of 2016 in Crl.O.P.No.30230 of 2015 B.RAJENDRAN,J.

This petition has been filed to modify one of the condition in the Anticipatory Bail to the petitioner by this Court in Crl.O.P.No.30230 of 2015 by order dated 28.01.2016.

2. This Court has granted anticipatory bail in Crl.O.P.No.30230 of 2015 dated 28.01.2016, on condition that the petitioner shall pay a sum of Rs.1,00,00,000/- (Rupees One Crore) directly to the second respondent/defacto complainant by way of Demand Draft and to deposit a sum of Rs.50,00,000/- (Rupees fifty lakhs only) to the credit of the case in Crime No.247 of 2014 on the file of the learned XI Metropolitan Magistrate, Saidapet, Chennai within a period of six weeks from the date of receipt of a copy of this order. The petitioner could not comply with the conditions and hence approaches this Court with this petition.

3. The learned counsel for the petitioner appeared before this Court regularly, but failed to comply with the conditional order dated 28.01.2016. The petitioner has not taken any steps to pay the amount to the defacto complainant or to deposit the amount before the concerned Magistrate Court

B.RAJENDRAN,J., kkd and without taking any steps for compliance of even any portion of the order of this Court, the petitioner has filed the petition for modification of the conditions imposed by this Court on 28.01.2016. hence the modification application filed, is dismissed. As on date he has not complied with the conditions imposed in the anticipatory bail application, he is not entitled to any relief in this petition.

4. In view of the above, this Criminal Miscellaneous Petition is dismissed.
