The writ petition has been filed under Article 226 of Constitution of India, to issue a writ of Certiorarified Mandamus Calling for the records relating to the impugned order passed by the 3rd respondent in Letter No. M.P /L/ MTPS-1/ LA/ Ko.Ve.Va/ A.No.195/ 2016 dated 16.08.2016 and quash the same as illegal and Consequently direct the respondents 1 to 3 to provide suitable employment assistant to the petitioner under the land loser employment scheme pursuant to acquisition of land belonging to the petitioners grandfather Marimuthu in Survey No.689/1, PN Patti Village, Mettur Taluk, Salem District by considering the petitioners representation dated 28.01.2026.

ORDER

This petition filed seeking to quash the impugned order passed by the 3rd respondent dated 16.08.2016 and Consequently, direct the respondents 1 to 3 to provide suitable employment assistant to the petitioner under the land loser employment scheme pursuant to acquisition of land belonging to the petitioners grandfather Marimuthu in Survey No.689/1, PN Patti Village, Mettur Taluk, Salem District by considering the petitioners representation dated 28.01.2026.

2. It is the case of the petitioner that his grandfather was the original owner of the land measuring 2.91 acres in S.No.689/1 PN Patti Village, Mettur

Taluk, Salem District which was acquired by the Government in the year 1987 for ash dumping yard purposes and at the time of acqusition, the Government assured employment assistance to one eligible member of the land loser's family in terms of G.O.Ms.No.656 dated 29.06.1978 and though compensation was paid, employment assistance was not granted to the petitioner's grandfather's family and instead, the respondents illegally granted employment to the 4th respondent, who is merely a purchaser of a portion of the property and not a family member of the original land loser and the petitioner's grandfather approached this Court in WP.no.15242 of 2015, wherein this Court directed the respondents to consider his representation. However, without conducting proper enquiry and without issuing notice to the legal heirs, the respondents passed the impugned rejection order after the death of the petitioner's grandfather, wrongly treating the 4th respondent as a family beneficiary. Challenigng the rejected order, the petitioner has filed the present writ petition.

3. The learned counsel for the petitioner submitted that without interfering with the impugned order dated 16.08.2016, this Court may direct the respondents to consider and pass orders on the petitioners representation dated 28.01.2026 within the stipulated time as fixed by this Court.

4. The learned counsel appearing for the respondent submitted that the representation will be considered and orders will be passed within the stipulated

time as fixed by this Court.

5. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court without interfering with the impugned order, directs the 3rd respondent to consider and pass orders on the petitioner's representation dated ......... within a period of four weeks from the date of receipt of a copy of this order, after providing opportunity to the petitioner and the private respondents.
