ORDER
The petitioner, who was arrested on execution of non-bailable warrant and remanded to judicial custody on 20.08.2025 for the alleged offences under Section 302 read with 34 and 201 of IPC in Cr. No.759 of 2021 on the file of the respondent police, which was taken on the file of learned XVII Additional Sessions Judge, Chennai in S.C. No.336 of 2023, seeks bail.

The learned counsel for the petitioner would submit that non-bailable warrant was ordered against the petitioner on 23.07.2025 and he was arrested on execution of non-bailable warrant on 20.08.2025. It is the further submission of the petitioner that now the trial is in an advanced stage. Apart from that, the learned counsel would submit that the co-accused has been released on bail by this Court vide order passed in Crl. O.P. No.29236 of 2025 dated 028.10.2025 and hence prayed to enlarge the petitioner on bail.

At this juncture, the learned Government Advocate (Criminal side) appearing for the respondent police would strongly objected the bail application stating that 16 witnesses have been examined in this case and the trial is in final stage. He would further submit that the petitioner has 15 previous cases and hence if he released on bail, it would jeopardise the progress of the trial.
5. I have given anxious consideration to the submissions made by the learned counsel on either side.
6. Considering the past conduct of the petitioner, upon the fact that the petitioner has 15 previous cases, and as rightly contended by the learned Government Advocate. the petitioner cannot seek parity, as the co-accused has no previous cases, and upon the fact that in this case, trial is in advanced stage. Therefore as rightly contended by the learned Government Advocate that if the
petitioner is enlarged on bail, there is every possibility of delay in trial and hence, this Court is not inclined to enlarge the petitioner on bail at present.
7. Accordingly, this Criminal Original Petition is dismissed. 09-04-2026 MJS Note:
