Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the Respondent to register the Rectification Deed dated 04.02.2019 executed by the Petitioner unilaterally to rectify the typographical errors occurred in mentioning the Petitioner's father date of death as 03.06.2009 instead of 30.06.2009 in the Release Deed No. 1617 of 2010 registered on 13.05.2010 and Settlement Deed No. 2277 of 2010 registered on 17.05.2010 on the file of the Respondent.

When it is pointed out that the Petitioner cannot call upon the Registering Authority to register the document, which has been unilaterally executed by him for rectification of errors in earlier documents executed in his favour in respect of the property, Learned Counsel for the Petitioner seeks permission of this Court to withdraw the Writ Petition and he has made an endorsement to that effect, which is recorded. It is needless to add here by way of clarification that it is open to the Petitioner to independently prove the correctness or otherwise of the facts stated in the recitals in the previous documents whenever necessary by producing relevant evidence in support of the same.

Accordingly, the Writ Petition is dismissed as withdrawn with the aforesaid observations. No costs.
