ORDER

The present writ petition has been filed praying for a writ of Mandamus, to direct the respondent to refund the 25% bid amount of Rs.5,40,000/- with interest @ 24% per annum from 30.11.2009 till payment.

2. After submitting for a brief while, learned counsel for petitioner would request leave of this Court to approach the Ombudsman to seeks redressal of his grievance. He would request ten days time to submit a representation/complaint before the Ombudsman.

3. Learned counsel for respondent would submit that the petitioner may submit a representation/complaint before the Banking Ombudsman. He would further submit that if such representation/complaint is filed, the Banking Ombudsman would consider and appropriate orders would be passed after issuing notice to petitioner, within a time period to be stipulated by this Court. Agreed to by the learned counsel for petitioner.

4. While agreeing with the above submission of the respondent, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, it is open to the petitioner to submit a

representation/complaint before the Banking Ombudsman along with documentary evidence. If any such representation/complaint is submitted by petitioner, the same shall be considered without reference to limitation by the Banking Ombudsman Authority, on its own merits and orders shall be passed in accordance with law, after affording reasonable opportunity of hearing to petitioner, within a period of four (4) weeks from the date of such representation/complaint before the Banking Ombudsman. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
