2.This writ petition has been filed to prohibit the first respondent from proceeding further with the proceedings in Na.Ka.No.893/2026/A3 in view of the judgment passed by this Court in W.P. No.3716 of 2005. 3.The petitioners claim that in view of the aforesaid judgment passed by this Court in W.P. No.3716 of 2025, the first respondent is prohibited from proceeding further any proceedings in Na.Ka.No.893/2026/A3. According to the petitioners, arbitrarily and illegally they have been called for enquiry in the aforesaid proceedings by the first respondent despite the judgment passed in W.P. No.3716 of 2025, which protects the petitioners. They had given a representation on 29.01.2026 to the respondents requesting them not to proceed further in the proceedings, referred to supra. 4.

Necessarily, the said objections raised by the petitioners through the aforesaid representation will have to be considered by the first respondent before proceeding further in Na.Ka.No.893/2026/A3. The first respondent will have to necessarily give due consideration to the representation of the petitioners, referred to supra and only if the first respondent, after giving due consideration to the same, is of the opinion that there is no prohibition for the first respondent to proceed further, the first respondent can proceed further in the proceedings in Na.Ka.No.893/2026/A3.
