ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 420 of IPC in Crime No.83 of 2018, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution as per the defacto complainant is that the defacto complainant had given the complaint against the petitioner stating that he came in contact with the petitioner through face book and came to know that he is sending persons to abroad for employment. The defacto complainant approached the petitioner and demanded to send two of his persons to abroad and transferred the money to petitioner's Bank Account and that he has not performed any of the act and hence, the case was registered against the petitioner.

3. The learned counsel appearing for the petitioner would submit that the petitioner has been falsely implicated by the respondent for the alleged offence under Section 420 IPC for the occurrence which took place on 01.02.2018 and the defacto complainant have given the complaint on 06.07.2018, based on the complaint, the case was registered against the petitioner. Hence, he prayed for grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

The learned Government Advocate (Crl.Side) submitted that the the defacto complainant approached the petitioner and demanded to send two of his persons to abroad and Rs.16 1⁄2 lakhs has been transferred to the petitioner's account in Axis Bank, Labbai Kudikadu Branch, Cuddalore District and that the petitioner has not performed any of the act and he cheated the defacto complainant. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioner.

5. As the petitioner has cheated the defacto complainant, this Court is not inclined to accept his plea and hence, this Criminal Original Petition stands dismissed.
