..Respondents Writ petition is filed under Article 226 of Constitution of India, praying for issuance of writ of certiorarified mandamus, to call for the records relating to the charge memo bearing ref.No.R.No.34667/DA/08/S1 (45) dated 14.07.2010 issued by the 1st respondent and to quash the same as being without jurisdiction, arbitrary, belated and baseless and to pass such other orders or directions granting the petitioner his promotion, increments and other benefits which have been whithheld.

The captioned writ petition has been filed challenging the article of charges issued by the first respondent and also the show cause notice as to why enquiry should not be initiated.
2. Learned counsel for the Government Advocate has placed on record the order passed by the disciplinary authority which reveals that after enquiry, the enquiry officer has submitted a report stating that the charges against the petitioner are not proved and the said enquiry report has been accepted by the disciplinary authority.
3. In the light of the above, the relief sought for in this writ petition does not survive at present for adjudication.
4. It is needless to state that since the charges have been dropped against the petitioner, the promotion of the petitioner to be considered in accordance with law.

5. In view of the submissions made by the learned Government Advocate for the respondents, this Writ Petition is dismissed as infructuous. Consequently, connected miscellaneous petition is closed.
