ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Shri Kumarasamy, learned counsel, seeks leave to withdraw the petition.

2. Petition is dismissed as withdrawn. There shall be no order as to costs.

3. Counsel for petitioner also seeks refund of the sum of Rs.50,000/- that was deposited by petitioner on 3rd April, 2024 in response to the order dated 22nd March, 2024. Counsel says petitioner recently underwent a cardiac bypass surgery and to meet the expenses of treatment, he prays for returning the amount of Rs.50,000/- deposited in this court. Counsel says he has authority to give an undertaking to the court that for at least one more year from today, petitioner will not file any public interest litigation on the same issue or any other.

4. In view of this undertaking given, Shri Kumarasamy states the court may, if it deems fit, consider returning the amount of Rs.50,000/-.

5. In view of what is recorded above, the Registry is directed to return the amount of Rs.50,000/- (Rupees Fifty Thousand only) deposited by petitioner without any deduction.
