Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to Writ of Mandamus, forbearing the 2nd respondent from conducting any enquiry, to be made on 07.04.2022 at 2.30 P.M. by Enquiry Committee which was appointed by the 2nd respondent in which any Homeopathy Doctor is found, with the petitioner who gave allopathy treatment or any other subsequent date/s.

This writ petition is premature seeing as the grievance is as regards communication dated 21.03.2021 calling upon the petitioner to appear and attend the enquiry. The hearing was scheduled on 07.04.2022, on which date the petitioner did not appear.

2.Though learned counsel for the petitioner states that a written response has been given to the show cause notice dated 14.09.2021, no such reply has been produced before me. Hence, this writ petition is dismissed granting liberty to the petitioner to file a reply, if he is so inclined within a period of two (2) weeks from today.

3. The petitioner will be issued a notice by the respondents, heard and thereafter an order passed by the authority in accordance with law and all applicable rules and regulations. This exercise shall be concluded within a period of six (6) weeks from today including the time granted for filing of reply. No costs. Consequently, connected miscellaneous petition is closed.
