ORDER

The petitioner/wife seeks transfer of H.M.O.P.No.109 of 2025 pending on the file of the Family Court at Coimbatore to the file of the Family Court at Chennai.

2. Despite service of notice in the above Transfer CMP, the respondent/husband, has chosen not to appear before this Court either in person or through counsel. Hence, the respondent is called and set exparte.

3. I have proceeded to hear the learned counsel for the petitioner and I have also gone through the affidavit filed in support of this transfer petition and the documents filed by way of typed set of papers.

4. The case of the petitioner is that the respondent/husband has initiated HMOP.No.109 of 2025 before the Family Court at Coimbatore, seeking dissolution of the marriage. The petitioner was originally residing in Coimbatore and now she has shifted to Chennai along with her parents. In support of the same, she has also annexed the necessary documents in the typed set of papers.

5. In any event, the convenience of the wife being on paramount consideration and since prima facie case has been made out by the petitioner/wife for transfer, this Transfer Civil Miscellaneous Petition is Page No.2 of 4

allowed and the case in H.M.O.P.No.109 of 2025 is hereby withdrawn from the file of the Family Court at Coimbatore and transferred to the file of the Family Court, Chennai to be taken up either by the Family Court, Chennai or at its discretion be posted to any of the other Additional Family Courts, considering the pendency of the cases pending before the Family Courts in Chennai. There shall be no order as to costs.
