ORDER

The petitioner, who was arrested and remanded to judicial custody on 03.02.2026 for the alleged offences punishable under Sections 191(2), 191(3), 126(2), 296(b), 115(2), 118(2), 309(4), 311, 351(3) of the Bharatiya Nyaya Sanhita, 2023 in Crime No.49 of 2026 on the file of the respondent police, seek bail.

2. The case of the prosecution is that on 03.02.2026 at about 16:00 hours, the petitioner waylaid the defacto complainant demanded money and upon refusal, assaulted him and robbed a sum of Rs.850/- and also threatened him with dire consequences.

3. The learned counsel appearing for the petitioner would submit that the petitioner has been falsely implicated in this case and that he has no connection with the alleged occurrence. It is further submitted that the petitioner is willing to abide by any condition imposed by this Court and that he will not abscond or misuse the liberty granted to him.

4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that there are about 10 previous cases pending against the petitioner and that he is a habitual offender. It is further submitted that if the petitioner is released on bail, there is a likelihood of his indulging in similar offences. Hence, he opposed the grant of bail.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. From the submission of the learned counsel on either side, this Court is of the view that considering the fact that there are ten previous cases pending

against the petitioner. Hence, if the petitioner is enlarged on bail, there is every possibility of the petitioner involving himself in further criminal activities. Hence, this Court is not inclined to grant bail to the petitioner at this stage.
