Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, i) Directing the 2nd respondent to order proper investigation and laying of Final Report under his personal supervision; ii) Direct the 1st respondent to award a Compensation of Rs.10,00,000/- (Ten Laksh Only) to the mother of the victim girl Mrs.Shoba and disburse the same at earliest; iii) Direct the 1st and 3rd respondents to ensure that suitable actions are taking against the 4th respondent; iv) Further to issue a direction to the 1st respondent to set up a Committee/ probe panel and to independently look into the treatment of children in the Government School in particular and other 1/4
schools in general and seek recommendations to protect the rights of children on a whole in the state; v) Direct the I Respondent to start proper training and filtering programme to equip teachers and others who deal closely with children and minors on proper decorum and treatment of children. ORDER
This writ petition has been filed seeking for directions as follows: i) directing the 2nd respondent to order proper investigation and laying of Final Report under his personal supervision;
ii) direct the 1st respondent to award a Compensation of Rs.10,00,000/- (Ten Laksh Only) to the mother of the victim girl Mrs.Shoba and disburse the same at earliest;
iii) direct the 1st and 3rd respondents to ensure that suitable actions are taking against the 4th respondent;
iv) further to issue a direction to the 1st respondent to set up a Committee/ probe panel and to independently look into the treatment of children in the Government School in particular and other schools in general and seek recommendations to protect the rights of children on a whole in the state; v) direct the I Respondent to start proper training and filtering programme to equip teachers and others who deal closely with children and minors on proper decorum and treatment of children.

2. It is the contention of the petitioner that her daughter, minor child aged 14 years was studying in the fourth respondent school. On 25.02.2014, she had returned home in the evening from school, doused herself with kerosene and set herself ablaze and thereafter, she succumbed to burn injury. According to the petitioner, one teacher namely Mrs.Rani was the sole reason for her minor child to commit suicide, therefore, seeks direction for investigation and proper compensation.
3. The learned Additional Public Prosecutor Pleader had brought to the notice of this Court that dying declaration is also recorded and now, the investigation will be completed and final report be filed.
4. Such view of the matter, since the dying declaration is already recorded, the investigation officer shall file final report and it is for the investigation officer to file either positive or negative report based on the materials collected. The said report shall be filed within a period of two months from today.
