For Petitioner : Mr.R.Prabakar in both cases COMMON ORDER These Criminal Original Petitions are filed to set aside the cost of Rs.10,000/- imposed in the common order dated 14.02.2024 made in Crl.M.P.No.1399 of 2023 & Crl.M.P.No.1340 of 2023 respectively in S.T.C.No.399 of 2022 on the file of the Judicial Magistrate, Fast Track Court No.1 @ ML, Coimbatore.
2. The Learned Counsel appearing for the petitioner states that the petition under Section 311 of Cr.P.C., is filed to reopen and recall P.W.1 for cross examination. The trial Court has allowed the petition on condition with costs of Rs.10,000/- that P.W.1/complainant shall be cross examined on the same day of his next appearance. Hence, the present Criminal Original Petition is filed to set aside the costs imposed on the petitioner.
3. This Court finds no merit to entertain this petition. Accordingly, these Criminal Original Petitions are dismissed.
