( Civil Appellate Jurisdiction ) Wednesday, the Thirty First day of January Two Thousand Eighteen PRESENT THE HON'BLE MR.JUSTICE S.BASKARAN CMP No.2481 of 2017 in CMA No.2592 of 2016 M.ANNAPOORANI [ PETITIONER ] Vs 1 ANAND MUTHUKUMAR [ RESPONDENTS ] 2 M/S ICICI LOMBARD GENERAL INSURANCE CO LTD, ARIHANT PLAZA 1ST FLR, NO.84 & 85 WALL TAX ROAD, CHENNAI 600 003 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to receive the copy of the mutual divorce decree from my husband's in OP NO.2851/2012 on the file of Additional Family Court, Chennai dated 25/02/2013 as additional evidence in this appeal pending CMA No.2592 of 2016.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S. T.G. BALACHANDRAN, Advocate for the petitioner and of M/S.R.SREEVIDHYA Advocate for the 2nd respondent Advocate for the 2nd respondent the court made the following order:- The petitioner has come forward with this petition seeking to file a copy of order passed in O.P.No.2851 of 2012 on the file of the Additional Family Court, Chennai dated 25.02.2013, granting divorce between the petitioner and her husband under section 13-B of the Hindu Marriage Act,1955.

2. The learned counsel for the petitioner contended that in the said order copy, head injury suffered by the petitioner is mentioned and the reason was established and witness to the same, the copy of the order will be produced. Hence the petition.

3. The learned counsel for the respondent even though opposed the petition stating that the document produced is no way connected with this case, considering the fact that the copy of order is relating to the petitioner, this Court is inclined to entertain the petition.

4. In the result, the petition is allowed and the document is received and marked as Ex.P.21 by consent. The Registry is directed to call for records from the trial Court. List the matter on 09.02.2018.
