ORDER
This petition has been filed to withdraw the petition in I.D.O.P.No.289 of 2025 on the file of the Principal District and Sessions Judge at Tiruvallur and transfer the same to the file of the Family Court, Chennai. 2.Heard both sides and perused the materials available on record. 3.Learned counsel appearing for the petitioner submits that the petitioner has shifted her residence to Moolakadai from Madhavaram and the distance between the petitioner's residence and the Principal District and Sessions Judge, Tiruvallur is approximately 60 k.m. She further submits that for each and every hearings, the petitioner finds it very difficult to attend the Principal District and Sessions Judge, Tiruvallur. Therefore, she prayed the case in I.D.O.P.No.
289 of 2025 may be withdrawn from the file of the Principal District and Sessions Judge, Tiruvallur and transferred to the Family Court, Chennai. 4.Per contra, learned counsel appearing for the respondent raised objection and submits that the respondent is working in a private concern. He further submits that if the case is transferred from the Principal District and Sessions Judge, Tiruvallur to the Family Court, Chennai it would cause much inconvenience to the respondent.
5.I have gone through the affidavit filed in support this petition and I find no merit in the submissions made by the learned counsel for the petitioner/wife. 6.The reason assigned by the petitioner is not justifiable. Therefore, this Court is not inclined to transfer the case from the Principal District and Sessions Judge, Tiruvallur to the Family Court, Chennai. The personal appearance of the petitioner before the Principal District and Sessions Judge, Tiruvallur is dispensed with. However, the petitioner is directed to appear before the Principal District and Sessions Judge, Tiruvallur as and when required. Accordingly, this transfer civil miscellaneous petition is dismissed. No costs.
