4. Heard Mrs.R.Saranya, learned counsel for the accused, who submitted that the accused had borrowed only Rs.39 Lakhs in all and that the complaint has been filed falsely. She also contended that on the complaint given by Shanmuga Sundaram (A2) against Mahalaxmi & Sons and Vinitha Associates, based on which, a case in Crime No.206 of 2018 has been registered on 15.03.2018 under Section 4 of the Tamil Nadu Prohibition of Charging Exorbitant Interest Act, 2003 and 294(b) and 506(ii) IPC and the investigation is pending. On such a petition being filed, the trial Court may liberally consider the same. If the accused adopt any dilatory tactics, it is open to the trial Court to insist upon their presence and remand them to custody as laid down by the Supreme Court in State of Uttar Pradesh vs. Shambhu Nath Singh [JT 2001 (4) SC 319]. If the accused abscond, the trial Court shall direct registration of an FIR against them under Section 229-A IPC. Connected miscellaneous petitions are closed.
