O RDER This Criminal Original Petition has been filed to direct the first respondent to execute the Bailable Warrant issued in S.T.C. No. 2747 of 2023, on 14.03.2024, by the Fast Track Metropolitan Magistrate Court No.IV at George Town, Chennai.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the first respondent and perused the materials available on record.
3. The petitioner is the complainant and the second respondent is the accused in S.T.C No. 2747 of 2023 on the file of the Fast Track Metropolitan Magistrate Court No. IV at George Town, Chennai, for the offence under Section 138 of the Negotiable Instruments Act. After receipt of summons, the second respondent did not appear before the Trial Court, and as such, the Trial Court issued a Bailable Warrant, and it is pending on the file of the first respondent.
4. In view of the above, the first respondent is directed to execute the Bailable Warrant as against the second respondent in S.T.C No. 2747 of 2023 within a period of twelve weeks from the date of receipt of a copy of this order. The petitioner is directed to furnish the correct address of the second respondent and cooperate while executing the Bailable Warrant as against the second respondent.
5. With the above directions, this Criminal Original Petition is disposed of.
