Writ petition filed under Article 226 of the Constitution of India praying to issue a Writ, Order or Direction, particularly in the nature of Writ of Mandamus, directing Respondents 1 and 2 to

approve the admission of 52 students (named at Serial No.11 of the typeset) made to D.T.Ed course for the academic year 2009-11 and to consequently permit the students to get their Diploma Certificates on their successful completion of the course.

ORDER

The WMP has been taken up by the petitioner Institution to publish the result of the 52 candidates. The main writ petition is to approve the admissions of 52 students admitted in D.T.Ed course for the academic year 2009-11.

2.Pending disposal of the writ petition in M.P.No.2 of 2011, by order dated 13.06.2011, this Court permitted the candidates to write the examination and the result shall not be published until further orders. Pursuant to the orders passed by this Court, the candidates were permitted to write the examination and therefore now the Institution is before this Court seeking direction to publish the examination results.

3.Mrs.N.Mala, Additional Government Pleader (Puducherry) submitted that by getting orders stage by stage, the irregular admissions are sought to be regularised and opposed the direction. 4.Heard the parties and perused the records.

5.By virtue of the orders of this Court only the candidates are permitted to write the examination. However, the results are not published due to the condition imposed by this Court. Having written the examination, the candidates are entitled to know their results. Publication of result pending disposal of the writ petition will not confer any right to the candidates. The respondents though are directed to publish the result are restrained from giving or handing over the Mark-sheet or Diploma. The handing over of the Mark-sheet and the Diplomas would be subject to the result of the writ petition and no further petition is maintainable by the petitioner for handing over the Mark-sheet or for the Diploma. It is also made clear that the candidates are not entitled to register their names in the Employment Exchange without succeeding in the writ petition. With the above conditions the direction is granted as prayed for.

6.This writ petition is ordered accordingly. No costs.
