WP No. 9545 of 2026 PRAYER: Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the respondent to pay the petitioner the difference /arrears of terminal benefits namely Gratuity and Encashment of Leave after revising the same based on the scale of pay payable to him from 01.09.23, as admitted by the respondent in the RTI information

dated 18.12.25 together with 18 percentage interest per annum within a time frame.

" directing the respondent to pay the petitioner the difference /arrears of terminal benefits namely Gratuity and Encashment of Leave after revising the same based on the scale of pay payable to him from 1.9.23 as admitted by the respondent in the RTI information dated 20.11.25 together with 18 percentage interest per annum within a time frame"

W.P.No.9546 of 2026:

" directing the respondent to pay the petitioner the difference /arrears of terminal benefits namely Gratuity and Encashment of Leave after revising the same based on the scale of pay payable to him from 01.09.23, as admitted by the respondent in the RTI information dated 17.01.26 together with 18 percentage interest per annum within a time frame."

W.P.No.9545 of 2026:

" directing the respondent to pay the petitioner the difference /arrears of terminal benefits namely Gratuity and Encashment of Leave after revising the same based on the scale of pay payable to him from 01.09.23, as admitted by the respondent in the RTI

information dated 18.12.25 together with 18 percentage interest per annum within a time frame."

2. The brief facts which has culminated in the filing of these writ petitions are set out below:

2.1. It is the case of the petitioners in W.P.Nos.9534, 9546 and 9545 of 2026 that they were appointed as Conductor and Driver respectively in the respondent Corporation and while they were working as "Special Grade Conductor" and "Special Grade Driver" respectively, they retired from service on attaining superannuation.

2.2. They further submits that their scale of pay should be refixed with effect from 01.09.2023 based on the new settlement dated 29.05.2025, which will increase their pay on the month of the retirement also and therefore, the respondent is liable to pay the arrears of the terminal benefits after revising the petitioners' scale of pay.

3. The petitioners had made a representation to the respondent to pay them the difference/arrears payment with interest. However, the same had not been considered to date by the respondent. Hence, the petitioners are before this Court.

4. Heard the learned Counsel on either side and perused the records.

5. Considering the limited request of the petitioners and taking note of the fact that the petitioners' representation has not been considered to date by the Respondent, a mandamus, is therefore, issued to the respondent to pay the difference/arrears of terminal benefits namely Gratuity and Encashment of Leave after revising the same based on the scale of pay payable to the petitioners from 01.9.23 as admitted by the respondent in the respective RTI information dated 20.11.25, 18.12.2025 and 17.01.2026, together with 6 percentage interest per annum within a period of one month from the date of receipt of a copy of this order.

6. Accordingly, these Writ Petitions are allowed. There shall be no order as to costs.
