ORDER

The writ petition is filed for the relief set out below: "directing the respondent to pay the petitioner the difference/arrears of terminal benefits namely Gratuity and Encashment of Leave after revising the same based on the scale of

pay payable to him from 1.9.23 as admitted by the respondent in the RTI information dated 20.11.25 together with 18 percentage interest per annum within a time frame."

2. The brief facts which has culminated in the filing of this writ petition are set out below:

2.1. It is the case of the petitioner that he was appointed as a Conductor in the respondent Corporation and while he was working as "Special Grade Conductor" he retired from service on attaining superannuation. 2.2. He further submits that his scale of pay should be refixed with effect from 01.09.2023 based on the new settlement dated 29.05.2025, which will increase his pay on the month of the retirement also and therefore, the respondent are liable to pay the arrears of the terminal benefits after revising the petitioner's scale of pay.

3. The petitioner had made a representation to the respondent to pay him the difference/arrears payment with interest. However, the same had not been considered to date by the respondent. Hence, the petitioner is before this Court.

4. Heard the learned Counsel on either side and perused the records.

5. Considering the limited request of the petitioner and taking note of the

fact that the petitioner's representation has not been considered to date by the Respondent, a mandamus, is therefore, issued to the respondent to pay the difference/arrears of terminal benefits namely Gratuity and Encashment of Leave after revising the same based on the scale of pay payable to him from 1.9.23 as admitted by the respondent in the RTI information dated 20.11.25 together with 6 percentage interest per annum within a period of one month from the date of receipt of a copy of this order.

6. Accordingly, this Writ Petition is allowed. There shall be no order as to costs.
