PRAYER:

Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorari calling for records of the 1st respondent pertaining to its proceedings in I.D.No.10 of 2012 and quash the award dated 23.07.2015. For Petitioner : Mr.M.Muthappan For R2 : Mr.K.V.Ananthakrushnan

ORDER

By consent of both the parties, this writ petition is taken up for final disposal.

2. Challenging the award of reinstatement passed by the Labour Court, the present Writ Petition has been filed.

3. While the learned counsel for the petitioner would submit that the matter has been settled among the parties, the learned counsel for the second respondent would submit that he has no instructions.

4. Today, when the matter was called, the learned counsel for the petitioner/Management had produced a copy of the Memorandum of Compromise entered into between the petitionerManagement and the second respondent on 01.09.2020, which evidences that the dispute between them has been amicably resolved. A copy of the undertaking given by the second respondent, dated 01.09.2020, together with a cheque bearing No.572237, dated 01.09.2020 issued by the petitioner to the second respondent, has also been produced.

5. On an overall perusal of the Memorandum of Compromise and the full and final settlement made, the dispute between the parties seems to have been amicably settled and as such, no effective orders can be passed in the present writ petition. Accordingly, the Writ Petition stands closed. No costs. Consequently, connected miscellaneous petitions are closed.
