ORDER

The criminal original petition has been filed for a direction to the respondent police to provide protection to the petitioner and his family members for fixing angle for fitting "Temple Bell", and offering the same to Arulmigu Periyandichi Amman Koil in K.R.Thoppur.

It is the grievance of the petitioner that the respondents 2 to 7 herein are preventing him from erecting a bell inside the temple premises.

Today when the matter was called, the learned counsel appearing for the respondents 2 to 7 submitted that a counter has been filed stating that there was a dispute earlier between four groups, in which the petitioner happens to be belonging to second group. In view of the dispute, a peace committee meeting came to be held on 25.11.2012. The four groups had arrived at an arrangement by which it was decided that none of the articles inside the temple should be disturbed and that all the items in the temple shall continue to be maintained without any disturbance. The learned counsel for the respondents 2 to 7 also submitted that the petitioner has been regularly offering prayers in the temple and that no disturbance has been caused from their side.

It is further seen from the photographs circulated before this court, that two temple bells are already existing inside the temple premises. Hence, Permitting the petitioner herein to erect the third bell inside the temple premises, would only give way to each member of the group to contravene the decision taken in the peace committee.

In order to ensure that peace prevails in the temple premises, it would be appropriate that the arrangement and agreement entered into between the rival groups, pursuant to the peace committee decision taken on 25.11.2012, shall continue. Under these circumstances, I do not find any merits on the claim made by the petitioner in the present petition. Hence the criminal original petitions stands dismissed.
