O R D E R

This Writ Petition has been filed for issue of a Writ of Mandamus directing the first respondent to provide police protection to conduct the festival from 16.04.2021 to 26.04.2021 in Sri Thirowpathi Amman Thirukkoil, Ayyaneri Village, based on the petitioner's representation dated 26.03.2021.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3.The learned Additional Public Prosecutor appearing for the respondents submitted that there is a rival group which also claiming similar rights to conduct the said festival. Further, https://hcservices.ecourts.gov.in/hcservices/

the petitioner's complaint has been registered and the same was assigned with C.S.R.No.294 of 2021, whereas, the rival party i.e., one Rajini filed the complaint and the same was assigned with C.S.R.No.296 of 2021. He further submitted that after enquiry, both the complaints will be decided by conducting peace committee with officials to be constituted.

4.Since considering the present pandemic situation i.e., COVID-19, and considering the fact that the Government have restricted to conduct the festivals, this Court is of the opinion that it is better to avoid any congregations.

5. In view of the above, the learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition by granting liberty to file a fresh petition as and when cause of action arise.

6.Granting such liberty, this Writ Petition is dismissed as withdrawn. No costs.
