ORDER

This writ petition has been filed seeking for a direction to the first respondent to consider the petitioner's representation dated 18.12.2025 seeking for migration of mini bus permit. The petitioner had given a representation for the said purpose to the first respondent on 18.12.2025. Since the said representation was not considered, the petitioner has filed this writ petition.

2. Mr.N.Naveen Kumar, learned Government Advocate, accepts notice for respondents 1 and 2. Mr.H.Rajasekar, learned counsel, undertakes to file vakalath on behalf of the third respondent.

3. Learned counsel for the third respondent would submit that the representation of the petitioner cannot be entertained since the third respondent is already operating the route for which migration is sought for. Learned counsel also placed reliance upon G.O.Ms.No.198, dated 28.04.2025 in support of his contention. The objection raised by the third respondent before this Court can very well be raised before the first respondent.

4. No prejudice would be caused to the first respondent if the petitioner's representation dated 18.12.2025 is considered on merits and in accordance with law after hearing the objections of the third respondent within a time frame to be fixed by this Court.

5. This Court is not expressing any opinion on the merits of the respective contentions.

6. For the foregoing reasons, this Court directs the first respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 18.12.2025 seeking for migration of the bus permit after hearing the objections of the third respondent and any other party whom the first respondent deems fit to enquire within a period of twelve (12) weeks from the date of receipt of a copy of this order.

7. This writ petition is disposed of with the above direction. No costs.
