ORDER : The Court Made the following order :- The petitioner herein, who was arrested for the alleged offence under Section 4(1)(i), 4(1)(aaa) and 4(1-A) of TN Prohibition Act in Crime No.86 of 2022, and 4(1)(a) and 4(1-A) of TN Prohibition Act in Crime No.54 of 2022 seeks bail.
2. The petitioner herein was arrested on 11.03.2022 for the alleged possession of 115 litres of ID Arrack. He was also simultaneously arrested in a case, where he was shown as absconding accused in connection with the seizure of 22 litres of ID Arrack, which was carried in two wheeler having fake registration number.
3. The case of the prosecution is that the two wheeler bearing registration No. TN 52 E 2820 ( Hero Splender Pro ) was verified with RTO Office and found that the Registration Number belongs to one TVS Apache vehicle and Chassis Number belongs to another Hero Splender Pro vehicle. While this case was under investigation, the petitioner who fled away from the scene of Crime abandoning 22 litres of ID arrack in a two wheeler with fake Chassis number and the registration Number, https://hcservices.ecourts.gov.in/hcservices/
was arrested by the respondent police on 12.03.2022 for possessing of 115 litres of ID Arrack and selling it in retail to public.
4. The learned Additional Public Prosecutor states that apart from these two cases, there is yet another case similar in nature is pending against this petitioner.
5.Taking note of the fact that true owner of the vehicle which has been tampered with the registration number and the Chassis number has to be ascertained, these Criminal Original Petitions for bail are dismissed for the present.
