ORDER

The grievance of the petitioner in this writ petition is that till date, the sale deed bearing Document No. 294 of 2025 dated 20.01.2025 presented by the

petitioner for registration has not been returned to the petitioner.

2. According to the petitioner, he had purchased the property through an auction conducted by the executing court and had presented the sale deed for registration, which has not been returned till date.

3. Mr. U. Baranidharan, learned Special Government Pleader accepts notice on behalf of R1 and R2. On instructions, he would submit that since the respondents could not obtain valuation for the building, due to obstructions caused by third parties, there is a delay in releasing the sale deed to the petitioner. He would also submit, on instructions, that the petitioner himself has given a letter to the respondents confirming that there are obstructions in the property purchased by the petitioner through Court auction.

The learned Special Government Pleader appearing for the respondents, would submit, on instructions, that if police assistance is given, the respondents will make an attempt once again to make an inspection and thereafter, decide to release the sale deed to the petitioner. Since the Police Department is not a party respondent in this writ petition, this Court Suo Motu impleads the Inspector of Police, Kangeyam, Tiruppur District as the party third respondent in this writ petition. Registry is directed to carryout necessary amendment.

5. Mr. V. Meganathan, learned Government Advocate (Crl. Side) accepts notice on behalf of the newly impleaded third respondent as well.

6. For the foregoing reasons, this writ petition is disposed of by directing the second respondent to inspect the property, which is the subject matter of the sale deed dated 20.01.2025 presented by the petitioner for registration, with the assistance of the newly impleaded third respondent, and thereafter take a final decision with regard to the release of the sale deed dated 20.01.2025 to the petitioner, subject to payment of additional stamp duty if any by the petitioner. The second respondent shall complete the aforesaid exercise within a period of four weeks from the date of receipt of a copy of this order.
