Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to dispose of the petitioner's application dated 06.01.2014 for the name transfer along with the issuance of sale deed immediately besides pay petitioner Rs.15,00,000/- for the poor service rendered by the respondent to the petitioner and for mental agony and torture on account of the indifference of the respondent.

ORDER

The present writ petition has been filed for issuance of Writ of Mandamus directing the the respondent to dispose of the petitioner's application for name transfer along with the issuance of sale deed immediately besides pay petitioner Rs.15,00,000/- to the petitioner.

2. According to the petitioner, upon payment, her husband was allotted plot No.127 in Phase I, Sathuvachari measuring to an extent of 2400 sq.ft., in the year 1971 and he died in 1984. Thereafter, the petitioner applied for the name transfer in respect of the said plot, to the respondent, which was not considered. Hence, she made several representations, however, none yielded any positive response. Feeling aggrieved, the petitioner has come up with this writ petitioner for the aforesaid relief.

However, today, when the matter was taken up for consideration, the learned counsel appearing for the respondent, on instructions, submitted that if the petitioner approaches the respondent with the relevant documents, the respondent would consider the same and execute a sale deed in her favour within two weeks.

4. The learned counsel for the petitioner agreed to the submission so made by the learned counsel for the respondent.

5. Recording the submissions so made by the learned counsel on either side, this court directs the petitioner to approach the respondent authority with the required documents, within a period of two weeks from the date of receipt of a copy of this order. On such approach, the respondent authority shall consider the same and execute a sale deed in her favour, within a period of two weeks thereafter.

6. Accordingly, this writ petition stands disposed of. No costs.
