Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified mandamus, calling for the records pertaining to the tender notice published in the newspaper Thinathanthi dated 16.01.2013, by the second respondent, quash the said tender notice dated 16.01.2013 and consequently direct the second respondent to effect tender notice containing proper and necessary particulars so as to enable the general public including the petitioner to participate in the tender.

The tender notification published by the respondent in newspaper Thinathanthi dated 16.01.2013 is under challenge in this writ petition.

2. The tender is to transport the LPG cylinders from Indian Oil Corporation Depot to the place of the distributors. Though the writ petitioner raised several grounds on account of efflux of time, the same cannot be considered and pursuant to the tender notification the process had already been completed long back.

3. The learned counsel for the petitioner states that the respondents had not followed the procedures contemplated for the purpose of publishing the tender and prescribed terms and conditions.

4. This Court is of an opinion that the authorities competent are bound to follow the rules, terms and conditions scrupulously while issuing tender notification as well as while prescribing the qualifications and other eligibility criteria. All such rules and regulations are to be followed scrupulously in future with reference to the rules in force.
