PRAYER: This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents, to give electricity service connection to the petitioner's well in S.F No.45/1, Madathupalayam Village, Perundurai, Erode District as per his application dated 24.04.2023 within time stipulated by this Court.

O R D E R

This writ petition has been filed, directing the respondents, to give electricity service connection to the petitioner's well in S.F No.45/1, Madathupalayam Village, Perundurai, Erode District as per his application dated 24.04.2023 within time stipulated by this Court.

2. The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the property in S.F No.45/1, 2 & 3, Madathupalayam Village, Perundurai, Erode District as per the registered sale deed dated 03.10.2022. In order to doing agricultural operations, the petitioner dug a well in S.F No.45/1 and obtained no objection certificate from the Village Administrative Officer, Thingalur on 21.04.2023. Thereafter, on 24.04.2023, he

submitted an online application to the respondents to provide service connection to his well. After verification of all the documents, the respondents inspected the land and given the estimation charges to the tune of Rs.3,00,000/- and the petitioner also deposited the said charges. After receipt of the same, the respondent has not taken any steps to give the service connection to him. Hence, the present writ petition is filed.

However, during the pendency of the writ petition, the 3rd respondent passed an order dated 12.02.2024 directing the petitioner to produce the revenue records with regard to the pathway rights in S.F.No.44/1D, 44/5D, 44/6C, & 44/7C. If such proof is filed before the respondent, the respondent will consider the same and pass appropriate orders.

In view of the above, this writ petition is disposed of with a direction to the petitioner to produce the revenue records to show that he is entitled to enjoy the pathway in S.F.No.S.F.No.44/1D, 44/5D, 44/6C, & 44/7C. Upon such satisfaction, the 3rd respondent shall pass appropriate orders within a period of six(6) weeks from the date of receipt of a copy of this order. No costs.
