A.No.1560 of 2024 in C.S. No.61 of 2008 ABDUL QUDDHOSE, J.

This application has been filed by the third defendant seeking for reception of additional documents.

2.The additional documents sought to be received are the Board Resolution dated 29.05.2015 authorising the representative of the third defendant to let in oral and documentary evidence. Another document is the Amalgamation order dated 27.03.2007 passed by this Court in C.P. Nos.25 to 27 of 2007 in C.S. No.61 of 2008.

3.After giving due consideration to the nature of the documents, this Court is of the considered view that no prejudice would be caused to the respondents if the said documents are allowed to be marked as exhibits, subject to its admission, proof and relevancy. 4.Even though the learned counsel for the first respondent/plaintiff seeks time to file counter, this Court is of the considered view that there is no necessity to file counter, considering the nature of the documents sought to be received.

vga 5.Accordingly, this application is allowed as prayed for and the documents namely, the Board Resolution dated 29.05.2015 and the Amalgamation Order dated 27.03.2007 are allowed to be received and marked as exhibits on the side of the third defendant. However, the said documents are allowed to be received and marked as exhibits, subject to its admission, proof and relevancy.
