This writ petition has been filed challenging the office order No.SVPISTM/Admin/Pers./CJ/2013/5645 dated 04.03.2013, whereby the petitioner is sought to be relieved from service on the ground that the petitioner has attained the age of superannuation i.e., 58 years.
2. The said order was challenged on the ground that the petitioner was appointed on a contractual basis initially and the same was extended and valid upto 06.06.2014 and therefore, the question of relieving the petitioner on the ground of attaining the age of superannuation does not arise.
3. This court passed an interim order and accordingly, the petitioner was continued in service till 31.07.2013. While so, it was on 26.07.2013, the respondents passed another office order purportedly accepting the resignation submitted by the petitioner dated 12.03.2013 and thereby relieving the petitioner once again from service. There is no challenge to the said office order dated 26.07.2013 as on date.
4. In the light of the above and taking into consideration the fact that the petitioner was already reinstated into service and he is relieved from service by virtue of the officer order dated 26.07.2013, virtually the relief sought in this writ petition has become infructuous.
