Today, the matter is listed under the caption "for being mentioned" at the instance of the learned counsel for the petitioner.

2. The learned counsel for the petitioner would submit that now he is ready and willing to settle the balance amount, deducting the amount which was already deposited to the credit of the Trial Court. 3.

Considering the above submission, the paragraph No.7 of the order dated 27.09.2022 passed in Crl.R.C.No.728 of 2018 shall read as follows :- "7. Accordingly, this Criminal Revision is dismissed. However, the petitioner is at liberty to deposit the balance amount on or before 19.12.2022. If the petitioner deposits the balance amount, the conviction and sentence imposed by the Courts below shall stand automatically set aide. On such deposit, the respondent is permitted to withdraw the entire cheque amount by filing an appropriate application. It is made clear that the Trial Court shall permit the respondent to withdraw the said amount, without ordering notice to the

petitioner."

Registry is directed to replace the above paragraph in the order dated 27.09.2022 in Crl.R.C.No.728 of 2018 and issue a fresh order copy.
