The petitioners, who apprehend arrest for the alleged offence punishable under Sections 294(b), 506(i) of IPC r/w. 11(4), 12 of POCSO Act and 4 of Women Harassment Act, Section 6 of IT Act in Crime No.101 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the 1st petitioner herein followed the victim girl, who is a minor, while she was going to school and the petitioners herein forcibly took obscene photos of the victim girl and threatened her by showing the same. Hence, this complaint.

3. Learned Counsel for the petitioners submits that the petitioners have not committed any offence as alleged by the prosecution and due to previous enmity, they have been falsely implicated in this case in order to wreck vengeance. Hence, he prays for grant of anticipatory bail to the petitioners.

4. Learned Government Advocate(Crl.Side) submits that the victim girl is a minor and the petitioners forcibly took revealing pictures of the victim girl, threatened her to post the same in Social media and forced her to 1/3

have sexual relationship with them. He further submits that the Statement of the victim girl has been recorded under Section 164 Cr.P.C. Hence, he vehemently raised objections for grant of anticipatory bail to the petitioners.

On perusal of statement of the victim girl recorded under Section 164 Cr.P.C. reveals that, the petitioners herein took revealing pictures of the victim girl without her knowledge and forced the victim girl, who is a minor to have sexual relationship with them and when the same was refused by the victim girl, the petitioners posted some of the victim girl's pictures in the Social Media platform called Instagram, due to which, the mother of the victim girl consumed poison.

6. Considering the above said facts and also the case needs further investigation, and there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioners.

7. Accordingly, this Criminal original petition stands dismissed. 05.04.2023 rri 2/3
