ORDER

This Criminal Miscellaneous Petition has been filed by the State/Police to to condone the delay of 768 days in filing the appeal in Crl.A.SR.No.15553 of 2025 against the judgement passed in Special Calendar Case No.33 of 2021 dated 30.11.2022 by the Sessions Judge, Magalir Neethimandram, (FTMC), Udhagamandalam at Nilgiris.

2. The reason stated in the accompanying affidavit is not satisfied. The lethargic attitude of the police cannot be taken as a ground of technicality, however, since the offence is against Society and in the interest of justice, delay is condoned.
