This writ petition has been filed seeking issuance of Writ of Mandamus directing the first respondent to de-seal the petitioner's premises bearing Door No.3/206, Bhavani Main Road, Orichery Post and Village, Bhavani Taluk, Erode District forthwith based on the petitioner's representation dated 17.11.2023. 2.The learned counsel appearing for the petitioner submitted that the petitioner leased out his property in favour of one C.Somasundaram in which the said C.Somasundaram was running Ayurvedic Centre and on inspection, the first respondent found that the said C.Somasundaram was running the Ayurvedic Centre without any licence or authorization, thereby, the premises was sealed and criminal case was registered against the petitioner. Hence, this Court may permit the petitioner to file undertaking affidavit before the first respondent that he will not allow the said C.Somasundaram to run the Ayurvedic Centre and issue direction to the first respondent to de-seal the petitioner's premises.
3.The petitioner's premises was sealed for running 2/4
unauthorized Ayurvedic Centre and criminal case was registered against the petitioner. Unless criminal case is over, the offender cannot be permitted to run Ayurvedic Centre. Hence, this Court is not inclined to grant the relief sought for in this writ petition. 4.The writ petition is dismissed. However, liberty is granted to the petitioner to file appropriate application before the trial Court where the criminal case is pending.
